Terms and Conditions (Australia)

Effective Date: 26 December 2025

These Terms and Conditions govern the use of TIKITAKA MARKET ("Platform", "we", "us", "our") when introducing, facilitating, or arranging the purchase of products that are not manufactured by TIKITAKA MARKET and aim to minimise legal disputes under Australian Consumer Law (ACL).

1. Platform Role & Legal Structure

TIKITAKA MARKET operates as a product introduction and agency-based purchasing platform.

  • We do not manufacture the products listed unless explicitly stated.

  • We act as a buying agent on behalf of customers for selected third-party products.

  • In certain cases, we act as a marketplace intermediary, connecting customers with third-party sellers or suppliers.

TIKITAKA MARKET is not the manufacturer, and unless expressly stated, not the retailer of record.

2. Nature of Transactions

Transactions fall into one of the following categories:

A. Agency Purchase

  • Customers appoint TIKITAKA MARKET as a limited purchasing agent.

  • We purchase the product on the customer’s behalf from a third-party supplier.

  • Ownership transfers directly from the supplier to the customer.

B. Marketplace Listing

  • TIKITAKA MARKET provides a platform for third-party sellers to list products.

  • The seller is responsible for product quality, compliance, warranties, and descriptions.

The applicable transaction type is disclosed on each product page.

3. Product Information

  • Product descriptions, specifications, images, and claims are provided by third-party suppliers.

  • While reasonable efforts are made to ensure accuracy, TIKITAKA MARKET does not guarantee all information is error-free.

  • Customers acknowledge that minor variations in colour, packaging, or specifications may occur.

4. Pricing, Fees & Payments

  • Displayed prices may include:

    • Product cost

    • Agency service fee

    • International sourcing or handling fees (if applicable)

  • Shipping, customs duties, GST, and import charges may be additional unless explicitly stated.

  • By placing an order, the customer agrees to pay all applicable fees.

5. Australian Consumer Law (ACL) Compliance

Nothing in these Terms excludes or limits rights under the Australian Consumer Law.

Customers acknowledge:

  • ACL guarantees apply primarily to the supplier or manufacturer.

  • TIKITAKA MARKET’s liability is limited to the scope of its agency role.

We will assist customers in communicating with suppliers to pursue ACL remedies where required by law.

6. Returns, Refunds & Cancellations

A. Change of Mind

  • Change-of-mind returns are not guaranteed.

  • Approval depends on the third-party supplier’s return policy.

  • Agency service fees are non-refundable once the purchase is executed.

B. Faulty or Not as Described

  • Claims must be submitted within a reasonable time with supporting evidence.

  • We will facilitate communication between the customer and supplier.

  • Refunds or replacements are subject to supplier approval and ACL obligations.

C. Custom or Special Orders

  • Custom-made or special-order items are non-cancelable and non-refundable unless required by law.

7. Warranties

  • Any manufacturer warranties are provided directly by the manufacturer or supplier.

  • TIKITAKA MARKET does not provide additional warranties unless explicitly stated in writing.

8. Limitation of Liability

To the maximum extent permitted by law:

  • TIKITAKA MARKET is not liable for indirect, incidental, or consequential losses.

  • Total liability is limited to the agency fee paid for the transaction.

  • We are not responsible for supplier delays, manufacturing defects, or regulatory non-compliance by suppliers.

9. Intellectual Property

All platform content, branding, and materials belong to TIKITAKA MARKET.
Third-party trademarks remain the property of their respective owners.

10. Dispute Resolution

  • Parties agree to attempt good-faith negotiation before legal action.

  • If unresolved, disputes will be handled under the laws of Victoria, Australia.

11. Amendments

TIKITAKA MARKET reserves the right to update these Terms and Conditions at any time.
The latest version will be published on our website and effective immediately upon posting.
